Energy & Law: EUSTACCHIO advises Austrian-Italian joint venture on ASFINAG tender – contract awarded for EUR 25.7 million for battery storage systems

Vienna, 2024 – Rechtsanwalt Dr Andreas Eustacchio has provided legal advice to ARGE Energy Königskreuz on its first cooperation in the context of a tender by the motorway concessionaire ASFINAG in Austria. The consortium consists of Energy S.p.A., a company listed on the Milan stock exchange that specialises in the production of storage systems for renewable energies in Italy, and Königskreuz GmbH from Upper Austria, which specialises in solar technologies for photovoltaic applications.

He was able to draw on his in-depth knowledge of the Italian and Austrian markets as well as his industry expertise. On the Italian side, he worked together with the law firm Macchion & Resoli.

Successful legal advice between Italy and Austria

A central component of the advice was the timely drafting and negotiation of the consortium agreement, which clearly defined the tasks and responsibilities of Energy S.p.A. and Königskreuz GmbH within the framework of the joint venture. This agreement had to ensure that all legal and technical provisions of the Austrian energy sector were complied with. To this end, it was first necessary to clarify which adjustments Italian Energy had to make for the Austrian market.

Future of the grid infrastructure

The successful collaboration will now enable the production and delivery of the battery storage systems and associated services worth 25.7 million euros for ASFINAG over the next 18 months. It is particularly noteworthy that the energy storage systems are produced by Energy S.p.A. in Italy and are thus products from the EU (European Union).

The tender was organised as part of a temporary joint venture with the Upper Austrian company Königskreuz GmbH. Energy is the lead partner in the consortium and will supply all storage systems and associated services worth 25.7 million euros for around 18 months from the summer. KönigsKreuz GmbH, based in Upper Austria, imports and markets high-quality solar technology for photovoltaic applications.
